WSJ says Hostess in talks to sell bread brands

NEW YORK (AP) ? The makers of Thomas' English muffins and Tastykake snacks are emerging as the two of the bidders for Wonder Bread and other Hostess bread brands as the company tries to sell off its assets under bankruptcy-court oversight, a newspaper reported Saturday.

The Wall Street Journal said Hostess Brands Inc. could reveal as early as next week that Flowers Foods Inc. and Grupo Bimbo SAB are in discussions to acquire the bread brands, which also include Nature's Pride. The report said the brands could command $350 million.

Grupo Bimbo's brands include Arnold breads, Thomas' English muffins and Entenmann's cakes. Flowers Foods Inc.'s brands include Nature's Own breads and Tastykake snacks.

Hostess sells Twinkies, Ding Dongs and Ho Hos, along with Dolly Madison cakes, which includes Coffee Cakes and Zingers. Hostess also sells Devil Dogs, Funny Bones, and Yodels under the Drake's brand.

Hostess, which is based in Irving, Texas, announced in November that it was shutting down its business and selling its bread, snacks and cakes brands along with its 33 bakeries and other operations.

The company's demise came after years of management turmoil and turnover. Workers said the company failed to invest in updating its snack cakes and breads. Hostess filed for its second Chapter 11 bankruptcy in less than a decade last year, citing steep costs associated with its unionized workforce.

The company was able to reach a new contract agreement with its largest union, the Teamsters, but the bakers union rejected the terms and went on strike Nov. 9. A week later, Hostess announced its plans to liquidate, saying the strike crippled its ability to maintain normal production. In 2011, the company's revenue was $2.5 billion.

Hostess declined to comment, as did Grupo Bimbo's U.S. division, Bimbo Bakeries USA. Bimbo's parent company is headquartered in Mexico. A message left with Flowers Foods, which is based in Thomasville, Ga., was not immediately returned.

Hostess said in bankruptcy court proceedings in December that it was narrowing down the bids it had received and that it expects to sell off its snack cakes and bread brands to different buyers.

Hostess said in December that it expects to file binding bids for many of its brands this month, followed by a four-week auction process to allow competing bids. Closings for many brands could come as soon as mid-March, according to Joshua Scherer of Perella Weinberg Partners, which is advising Hostess.

An attorney for Hostess said in court in December that 1,100 employees had been retained to shut down plants and perform other tasks as it winds down its operations. The liquidation of the company will ultimately mean the loss of 18,000 jobs, not including those shed in the years leading to the company's failure.

Detective: Holmes bought movie ticket weeks before shooting

CENTENNIAL, Colo.? Suspected mass murderer James Holmes purchased the movie tickets to the premier of ?The Dark Knight Rises? on July 8, 2012, almost two weeks before his alleged shooting rampage in the movie theater in Aurora, Colo.

That fact came from Det. Matthew Ingui, the first prosecution witness to testify in the afternoon session of Holmes' hearing.

Along with Det. Ingui?s testimony, the courtroom watched several minutes of video from a security surveillance camera showing Holmes coming inside the theater and hanging around for several minutes near the concession stand before entering Theater 9.

Holmes, who has not made a statement during the proceedings today, showed no outward emotion while the video was played for the court. But he however did watch closely as Det. Ingui used a Sharpie maker to write on a photo to illustrate where people died inside the Century 16 movie theater on July 20, 2012.

Det. Ingui said they were able to determine when Holmes bought the movie theater ticket from his cell phone, which he used at a kiosk inside the theater nearly 30 minutes before the first shots were fired.

The video also showed horrific scenes of masses of people running out of the theater?s front doors after the shots were fired at the premier of the Batman movie.

In the days after the rampage, Det. Ingui was a member of a team that collected live rounds of ammunition James Holmes left behind -- including 209 bullets for his assault rifle and 15 bullets for his handgun.

An Aurora police officer testified Monday morning that James Holmes didn't respond when he asked him behind the movie theater if accomplices helped him in the shooting rampage.

"He just looked at me and smiled," said police officer Justin Grizzle, recalling the moments after the arrest.

A prosecutor then pressed Officer Grizzle to define the expression.

"It was like a smirk," he said.

With Holmes in custody,? Officer Grizzle, a former paramedic, told the court that he then rushed into Theater 9, the scene of massacre.

"There were several bodies lying motionless," Officer Grizzle, who at times became emotional while on the stand. "I knew they needed to get to a hospital."

Instead of waiting for ambulances, Officer Grizzle said he decided to start transporting the critically wounded himself.

"I didn't want anybody else to die," Officer Grizzle tearfully testified.

With the help of other officers, Officer Grizzle personally took six victims to nearby ERs on four separate trips.

Some of the wounded were so bloodied, Grizzle said he couldn't recognize their race. On one trip, he had to yell at a man with a head wound to try and keep him alert.

"Don't f---ing die on me, don't f---ing die on me," Grizzle recalled for the court.

Many surviving victims or their family members in the courtroom wiped away tears. One woman shielded her face with a scarf. Another young lady collapsed into the arms of a man seated beside her.

When he was finally assuming the role of ambulance driver, Officer Grizzle described the horror scene inside his police cruiser.

"There was so much blood, I could hear it sloshing in the back of my car," he said.

Aurora police officer Jason Oviatt said he thought the suspect was a member of law enforcement at the rear of the theater since he was wearing a military helmet and gas mask similar to what officers wear.

?When I first saw him, I thought he might be a police officer,? Oviatt said at a hearing for Holmes.

But Oviatt held him at gunpoint because he wasn?t acting like a police officer. Holmes was just standing at his white car with his hands on the roof, not doing anything.

?The overall picture didn?t match of him being a police officer as I got closer,? Oviatt said.

After the Aurora officer handcuffed Holmes, he noticed a handgun on the roof of the car where his hands had been, he said. And as he grabbed Holmes by the arm to take him away, a magazine of ammunition fell to the ground, Oviatt said in the hearing.

When Oviatt asked Holmes how many weapons he had, Holmes responded: four.

Then Holmes volunteered that he had an improvised explosive device at his home. When asked if it would explode, Oviatt said, ?The suspect replied, ?If you trip them.? ?

Oviatt said Holmes was compliant and answered all his questions. He described him as relaxed. ?In his case he was very, very relaxed,? Oviatt said. ?He seemed very detached from it all.?

Oviatt and fellow Aurora officer Aaron Blue identified Holmes as the man they arrested at the car.

Blue helped with the initial arrest, but then left to transport a victim who was shot in the head to the hospital.

Oviatt, upon cross examination by the defense, said he told officers at headquarters that Holmes was staring off in the distance and was not with it. ?He was dripping with sweat and he smelled badly,? Oviatt said of Holmes.

About 40 members of the media and six front rows of survivors, victims? families and friends listened intently to the morning proceedings.

The biggest hearing thus far in the People of the State of Colorado v. James Eagan Holmes gets underway here Monday morning.

Anyone officially connected to the case has been under a gag order since Holmes was arrested in the July 20 movie theater massacre. All police reports, search warrants and other key records were ordered sealed.

This week's preliminary hearing will be the first public glimpse at the evidence prosecutors have against the man charged in the killing of 12 people and the wounding of 70 in the attack.

The hearing could last a week, as prosecutors outline particulars of their 166 counts of first-degree murder and attempted murder. The district attorney has not publicly stated if the death penalty will be sought.

Holmes' attorneys may call witnesses to help lay the groundwork for a possible insanity defense.

At the end, District Judge William Sylvester will decide if there is ample evidence to move to trial.

Giffords interview to air on shooting anniversary

(AP) ? A TV interview with former Arizona Rep. Gabrielle Giffords and her husband will air on the second anniversary of the Tucson shooting rampage that killed six and wounded Giffords and 12 others.

ABC says Giffords and retired astronaut Mark Kelly will speak during the interview about a new initiative they're launching. The network didn't specify what the initiative would aim to do.

A call to a Giffords spokeswoman wasn't immediately returned Sunday.

The interview by anchor Diane Sawyer will air at 6:30 p.m. EST Tuesday.

Giffords and Kelly met Friday with the families of victims in last month's shooting in Connecticut that left 26 people dead inside an elementary school. The couple met earlier in the week with New York Mayor Michael Bloomberg, a longtime gun control advocate.

Women's history pioneer Gerda Lerner dies at 92

Gerda Lerner founded the women's studies program at Sarah Lawrence College in Bronxville, New York, which in 1972 became the first to offer a graduate degree in women's history.

MILWAUKEE -- Gerda Lerner, a pioneer in the field of women's history and a founding member of the National Organization for Women, has died. She was 92.

Credited with founding the nation's first graduate program in women's history, Lerner died peacefully Wednesday at an assisted-living facility in Madison, Wis., her son said.

"She was always a very strong-willed and opinionated woman," Dan Lerner recalled. "I think those are the hallmarks of great people, people that have strong points of view and firmly held convictions."

The former professor at the University of Wisconsin-Madison wrote several books in the field of women's history, including her 1986 work "The Creation of Patriarchy" and her 1994 volume "The Creation of Feminist Consciousness."?She also edited "Black Women in White America," one of the first books to document the struggles and contributions of black women in American history.

After obtaining her doctorate at New York's Columbia University in 1966, Lerner went on to found the women's studies program at Sarah Lawrence College in Bronxville, New York, which in 1972 became the first to offer a graduate degree in women's history.

Lerner later moved to Madison, where she helped establish a doctoral program in women's history at the University of Wisconsin.

Imprisoned by Nazis
She was born into a privileged Jewish family in Vienna, Austria, in 1920. When the Nazis rose to power, she was imprisoned and spent her 18th birthday behind bars, in a cell with two other young women who had been arrested for political work. Jailers restricted rations for Jews, but the gentile women shared their food with her.

"They taught me how to survive," Lerner wrote in "Fireweed: a Political Autobiography." "Everything I needed to get through the rest of my life I learned in jail in those six weeks."

She said the experience taught her how society can manipulate people. It was a lesson she saw reinforced in American academia by history professors who taught as though the only figures worth studying were men.

"When I was faced with noticing that half the population has no history, and I was told that that's normal, I was able to resist the pressure" to accept that conclusion, she told the Wisconsin Academic Review in 2002.

After arriving in the United States from Europe, she married filmmaker Carl Lerner and collaborated with him in writing the 1964 civil rights-era film "Black Like Me," based on the 1961 best-selling book by John Howard Griffin.

The couple were involved in activism that ranged from attempting to unionize the film industry to working in the civil rights movement.

Carl Lerner died in 1973, and Gerda Lerner moved in 1980 to the University of Wisconsin-Madison, where she established a doctorate program in women's history.?She retired from the university in 1991.

When asked how she developed such a strong sense of justice and fairness, she told the Wisconsin Academy Review that the feeling started in childhood. She recalled watching her mother drop items on the floor and walk away, leaving servants to clean up her mess.

"I wanted the world to be a just and fair place, and it obviously wasn't ? and that disturbed me right from the beginning," she said.

Some gun shows canceling after Newtown shooting

SARATOGA SPRINGS, N.Y. (AP) ? Four gun shows, all about an hour's drive from Newtown, Conn., all canceled.

A show in White Plains, N.Y., ? brought back a few years ago after being called off for a decade because of the Columbine shooting ? is off because officials decided it didn't seem appropriate now, either. In Danbury, Conn. ? about 10 miles west of Newtown ? the venue backed out. Same with three other shows in New York's Hudson Valley, according to the organizer.

Gun advocates aren't backing down from their insistence on the right to keep and bear arms. But heightened sensitivities and raw nerves since the Newtown shooting have led to toned-down displays at gun shows and prompted some officials and sponsors to cancel the well-attended exhibitions altogether.

Some of the most popular guns will be missing from next weekend's gun show in Saratoga Springs, N.Y., after show organizers agreed to bar the display and sale of AR-15 military-style semiautomatic weapons and their large-clip magazines.

"The majority of people wanted these guns out of the city," said Chris Mathiesen, Saratoga Springs' public safety commissioner. "They don't want them sold in our city, and I agree. Newtown, Conn., is not that far away."

The mayor of Barre, Vt., wants a ban on military-style assault weapons being sold at an annual gun show in February. Mayor Thom Lauzon says he supports responsible gun ownership but is making the request "as a father." The police chief in Waterbury, Conn., just a few miles from Newtown, has halted permits for gun shows, saying he was concerned about firearms changing hands that might one day be used in a mass shooting.

In New York's suburban Westchester County, Executive Rob Astorino had brought back the show in 2010 after a ban of more than a decade following the 1999 Columbine High School shooting in Colorado, but he said the show would be inappropriate now. The shows in the Hudson Valley and Danbury were listed as canceled on the website for Big Al's Gun Shows. A man who answered the site's contact number said it was the venues that canceled the shows, not the promoter.

In Houston, transportation officials temporarily stopped using electronic freeway signs for public safety traffic updates near firearms-related events amid complaints following a gun show the day after the Dec. 14 school shooting. State-level transportation officials overruled the decision.

On Wednesday, the Saratoga Springs City Council urged organizers of a downtown gun show Jan. 12-13 not to display military-style weapons and the high-capacity magazines "of the type used in the Newtown tragedy." About a dozen people gave impassioned pleas at the meeting.

Show organizer David Petronis, of New Eastcoast Arms Collectors Associates, agreed to the limit.

"I don't think it's fair that we're taking the brunt of the problem," Petronis said, "but I can understand the reaction of people in doing so."

Petronis said his group is a "nice, clean family-oriented ... arms fair" that brings in thousands of visitors and a lot of money for the city. He stressed that buyers at his show undergo background checks, as per New York state law.

The gunman in the Sandy Hook Elementary School shooting in December used an AR-15 to kill 20 first-graders and six educators in the school. The gun belonged to the shooter's mother, but it's not clear where it was bought. The shooting has led to calls for stricter regulation of assault weapons, though the National Rifle Association has steadfastly opposed such measures.

Gun dealers around the country are reporting a spike in sales of semiautomatic rifles amid renewed talk of a federal ban on assault weapons. The possibility of tighter gun control has also pumped up attendance at gun shows in several states.

Marv Kraus, who helped organize a weekend gun show in Evansville, Wis., said business has been especially strong lately.

Kraus said there was never any reason to consider postponing or canceling the Wisconsin event, which runs from Friday through Sunday. One of the few vendors there with semiautomatic weapons, Scott Kuhl of Janesville, Wis., bristled at any suggestion that he temporarily stop selling semiautomatic weapons because of the Connecticut shooting.

"When a plane crashes, should they shut down the airline for six months?" Kuhl said. "This is my business; this is my livelihood."

Jared Hook, 40, who came to the show looking for a .223-caliber gun for coyote hunting, said he was glad vendors did not back away after Newtown.

"If anything, there's a lot more interest in guns now because of the shooting," Hook said. "People want them for protection, and it's good that they still have access to them."

Joel Koehler, a Pennsylvania gun dealer, said a few dealers have dropped out of a show this weekend in the Pocono Mountains, but only "because they have nothing to sell. They are out of inventory."

"The gun sales have been crazy. They are going through the roof," he said.

Koehler said he has felt no pressure to cancel his shows in Pennsylvania.

"The shows are going on," he said. "Nobody's said to us that we can't have them."

President Barack Obama has urged Congress to vote rapidly on measures that he says a majority of Americans support: a ban on the sale of military-style assault weapons; a ban on the sale of high-capacity magazines; and required criminal background checks for all gun buyers by removing loopholes that cover some sales, such as at gun shows in states that don't currently require checks.

Pennsylvania Gov. Tom Corbett on Friday said he would consider a radio-show caller's suggestion that gun shows be banned on publicly owned property, such as the Pennsylvania Farm Show Complex in Harrisburg. But he also noted that the complex is open to all businesses.

While government officials take a harder look at gun shows, organizers remain adamant that they run safe, legal businesses. There is no central government database on how guns used in crimes are obtained.

The Brady Campaign, which advocates for stricter state and federal gun laws, has long pushed to close the so-called "gun show loophole" by forcing every state to require background checks of buyers at the shows. They note that three of the weapons used in the Columbine attack were bought by someone who went to a gun show that didn't require a background check. Seventeen states require an extensive background check, according to the campaign.

And in the wake of Newtown is an emboldened group of advocates, like Susan Steer of Saratoga Springs, a 46-year-old married mother of three who started a petition seeking to cancel the local gun show. Steer said she'll continue to push for banning gun shows at the taxpayer-supported venue.

"For many of us," she said, "the shooting in Sandy Hook was the tipping point for taking some action."

(AP) ? Tens of thousands of Fatah supporters rallied in the Hamas stronghold of Gaza on Friday for the first time since they were routed from power in the territory by the Islamist militants in 2007.

The rally, approved by Gaza's Hamas rulers, marks a renewed attempt by the rival Palestinian factions to show unity following a fierce Hamas battle with Israel in November and Fatah's subsequent recognition bid at the United Nations.

But many obstacles still remain before the sides can settle their differences, chief among them how to deal with Israel. Several rounds of reconciliation talks over recent years centered on finding ways to share power have failed to yield results.

Still, both sides expressed optimism following Friday's unprecedented Fatah show of strength that included hours of waving their yellow flags, dancing in the streets and chanting party slogans. For years, Fatah loyalists in Gaza faced retribution from the Hamas regime, which banned them from gathering.

"We feel like birds freed from our cage today," said Fadwa Taleb, 46, who worked as a police officer for Fatah before the Hamas takeover and attended Friday's rally with her family. "We are happy and feel powerful again."

Top Fatah officials arrived in Gaza for the first time since they were violently ousted. Palestinian President Mahmoud Abbas, who rules the West Bank, did not attend the event, but he addressed the crowd on a large screen telling them "there is no substitute for national unity."

Hamas Prime Minister Ismail Haniyeh also expressed hope that the two factions could reconcile their differences, sending Fatah a message that he hoped they could work together as joint representatives of the Palestinian people, according to Fatah official Nabil Shaath. Hamas was not directly involved in the event.

Ihab al-Ghussian, the chief spokesman for the Hamas government in Gaza, said the sides would "work toward the consolidation of national unity." Egyptian officials say a first such meeting in months between the factions is scheduled for next week in Cairo.

After the rally, Haniyeh called Abbas to congratulate him and Abbas in turn thanked Haniyeh for letting it happen, said Haniyeh spokesman Taher al-Nunu. He added that both leaders expressed hope that the cooperation would lead to renewed reconciliation efforts.

The warmer tone is a result of recent gains by both factions.

Abbas has enjoyed a boost in his status since he led the Palestinians' successful bid to upgrade their status at the United Nations to a non-member observer state. On Friday, he signed a presidential decree officially changing the name of the Palestinian Authority to the "State of Palestine." All Palestinian stamps, signs and official letterhead will henceforth be changed to bear the new name, according to the official Palestinian news agency Wafa.

The move marked the first concrete, albeit symbolic, step the Palestinians have taken following the November decision by the United Nations. Abbas has hesitated to take more dramatic steps, like filing war crimes indictments against Israel at the International Criminal Court, a tactic that only a recognized state can carry out.

Hamas, meanwhile, has gained new support among Palestinians following eight days of fighting with Israel in November, during which Israel pounded the seaside strip from the air and sea, while Palestinians militants for the first time lobbed rockets toward Jerusalem and Tel Aviv.

Following the fighting, Fatah allowed Hamas to hold its first rally in the West Bank since the 2007 split. Hamas returned the favor Friday by allowing the Fatah rally to take place.

Still, the two sides have wide differences ? over Israel and over the possibility of sharing power.

Fatah has held several rounds of peace talks with the Jewish state and says it is committed to a two-state solution. Hamas does not recognize Israel and is officially committed to its destruction. Hamas has carried out hundreds of deadly attacks against Israeli citizens and is regarded by the U.S. and Israel as a terrorist organization.

Hamas political chief Khaled Mashaal, considered more pragmatic than the movement's Gaza-based hardline leaders, forged a reconciliation agreement with Abbas in 2011. But the Gaza-based leadership has held up implementing it and has blamed Fatah of doing the same.

Fatah enjoys Western support and has been pressured not to forge a unity agreement with the militant Hamas, facing a potential cutback in foreign aid if it does.

Friday's rally also served as a reminder of the conflicts within Fatah itself that continue to dog the movement: Officials cancelled the event halfway through after 20 people were injured due to overcrowding, and shoving matches erupted between separate Fatah factions.

Yahiya Rabah, a top Fatah official in Gaza, said the rally was cancelled "due to the huge number of participants and logistical failures."

But witnesses said one pushing match was between supporters of Abbas and partisans of Fatah's former Gaza security commander Mohammed Dahlan, who was expelled from the party because of conflicts with Abbas.

Another Fatah official, who spoke anonymously because he did not want to embarrass the party, said the rally was cancelled because hundreds of Dahlan supporters jumped up on the stage and clashed with Abbas supporters.

Fatah spokesman Fayez Abu Etta attributed the injuries to overcrowding and the excitement of the rally. Later, more Palestinians were injured when part of a stage collapsed. Youths also clashed and stabbings were reported. Gaza health official Ashraf al-Kidra said overall 55 people were injured, including three critically.

There was one death during the rally: A 23-year-old Fatah activist was electrocuted while trying to hang a flag on an electric pole.

Overnight, throngs had camped out in a downtown Gaza square to ensure themselves a spot for the anniversary commemoration of Fatah's 1965 founding, and tens of thousands marched early Friday carrying Fatah banners. When the rally began, people stampeded to the stage to try to shake leaders' hands.

New molecule to target in pancreatic cancer treatment

Jan. 3, 2013 ? Researchers at Mayo Clinic in Florida have identified a new target to improve treatment of pancreatic ductal adenocarcinoma cancer, which accounts for more than 95 percent of pancreatic cancer cases. This fast-growing, often lethal cancer is resistant to conventional chemotherapy.

The findings are published in the Jan. 3 online issue of PLOS ONE.

The researchers decoded a molecular pathway that is switched "on" at all times, promoting accelerated growth of pancreatic tumors, and that discovery revealed ways to disable the pathway. They say one strategy could involve the use of the drug bortezomib, which is already approved for several human blood cancers.

"Targeting this pathway to decrease the proliferation of cancer cells may represent a new strategy for pancreatic cancer therapy," says the study's senior investigator, Peter Storz, Ph.D., a biochemist and molecular biologist at Mayo Clinic.

One feature of pancreatic cancer is increased activity of the transcription factor NF-kB, which turns on expression of genes that keep the cells proliferating and protect them from death. There are two pathways, known as the classical and alternative, by which NF-kB can be activated, and the researchers looked at the alternative pathway -- one in which NF-kB is activated differently, and which switches on other genes, compared to the classical signaling pathway. Both the classical and alternative pathways are active in pancreatic cancer.

The research team discovered that increased activity of the alternative NF-kB pathway results from suppression of TNF receptor-associated factor 2, or TRAF2. Loss of TRAF2 promotes fast growth of pancreatic tumors and correlates with increased aggressiveness, Dr. Storz says.

They tested this discovery in 55 human samples of pancreatic cancer, and found that in 69 percent, TRAF2 wasn't functioning properly and there were higher levels of other molecules participating in the alternative pathway.

A cocktail of drugs that includes chemotherapy, bortezomib and other inhibitors of molecules activated along the pathway may help pancreatic cancer patients, Dr. Storz says.

"Of course, this hypothesis requires extensive clinical testing, but our findings offer a new direction to investigate in improving treatment of pancreatic cancer," he says.

The research team includes cancer biologists Heike D?ppler and Geou-Yarh Liou, Ph.D. from Mayo Clinic in Florida. The study was funded by grants from the American Association for Cancer Research and the National Institutes of Health (grant numbers CA135102, CA140182 and P50CA102701).

(AP) ? Members of Congress are calling for an investigation of Royal Dutch Shell PLC's Arctic offshore drilling operations as salvagers develop plans to move a company drill ship off rocks near an Alaska island, where it ran aground in a fierce year end storm.

Shell incident commander Sean Churchfield said Thursday that the first salvage crew on board the Kulluk, a 266-foot diameter barge with a 160-foot derrick, reported back with details that will be used to begin planning. He would not speculate on when a salvage report might be ready.

"There is still a lot of work to do to bring a safe conclusion to this incident," he said.

The vessel is upright and stable, with no indication of a fuel leak, Churchfield said.

The House Sustainable Energy and Environment Coalition, meanwhile, said in a statement that the New Year's Eve grounding should trigger a look at Shell's entire Arctic Ocean drilling operation by the Interior Department and the Coast Guard.

The coalition is made up of 45 House Democrats.

"The recent grounding of Shell's Kulluk oil rig amplifies the risks of drilling in the Arctic," they said in a joint statement. "This is the latest in a series of alarming blunders, including the near-grounding of another of Shell's Arctic drilling rigs, the 47-year-old Noble Discoverer, in Dutch Harbor and the failure of its blowout containment dome, the Arctic Challenger, in lake-like conditions."

The coalition believes these "serious incidents" warrant thorough investigation, the statement said.

Shell Alaska spokesman Curtis Smith said in an email that the company is in full support of, and is providing resources for, the investigation of the grounding by the Unified Incident Command, made up of federal, state and company representatives. Smith said the findings will be available to the public.

The Kulluk is a non-propelled vessel with a reinforced funnel-shaped hull designed to operate in ice. It is carrying more than 140,000 gallons of diesel and about 12,000 gallons of lube oil and hydraulic fluid. It drilled during the short open-water season last year in the Beaufort Sea.

A 360-foot anchor handler, the Aiviq, was towing the Kulluk from Dutch Harbor to Seattle last week for maintenance and upgrades when the tow line snapped south of Kodiak. Lines were reattached at least four times but could not be maintained. A lone tugboat still attached Monday night in a vicious storm couldn't control the vessel and cut it loose as it neared land.

After the grounding, critics quickly asserted it has foreshadowed what will happen north of the Bering Strait if drilling is allowed.

Environmentalists for years have said conditions are too harsh and the stakes too high to allow industrial development in the Arctic, where drilling sites are 1,000 miles or more from the closest Coast Guard base.

Two national organizations kept up the criticism Thursday by calling for a halt to all permitting for Arctic offshore drilling in the wake of the grounding.

"This string of mishaps by Shell makes it crystal clear that we are not ready to drill in the Arctic," said Chuck Clusen of the Natural Resources Defense Council. "Shell is not Arctic-ready. We have lost all faith in Shell, and they certainly don't have any credibility left."

Lois Epstein, a civil engineer who works for The Wilderness Society in Anchorage, said Shell has made troubling, non-precautionary decisions that put workers and the Coast Guard at risk.

"These ongoing technical and decision-making problems and their enormous associated costs and risks taken by our military personnel once there were problems should lead the federal government to reassess its previous permitting decisions regarding Shell," Epstein said.

Shell has maintained it has taken a heads-up approach to anticipating and reacting to problems.

Shell officials say the Kulluk had been towed more than 4,000 miles and has experienced similar storm conditions. Shell staged additional towing vessels along the route in case problems occurred, said Smith, the Shell spokesman.

"We know how to work in regions like this," Smith said. "Having said that, when flawless execution does not happen, you learn from it, and we will."

Apple is considered around the world as one of the most valuable, if not the most valuable company.[1] With a strong business and marketing sense, Apple is a master at providing innovative technology products that consumers scramble to purchase. With the invention of the iPod, Apple revolutionized content delivery of the music industry. And it continues to introduce other wildly successful products such as the iPhone. While some people may argue that other tech savvy companies have better products, few people can ignore the fact that Apple is a world famous brand and that its products continue to sell at high rates.

While Apple?s business practices, marketing methods, and products have provided it with great success, the company falls behind some of the major players in one area that has become essential in the technology industry?intellectual property, specifically patents. Patents provide protection in the event that a company is sued. Patents also allow companies to exclude others from the market for a specific timeframe. Without patents, companies would find it difficult to reap the rewards for inventions that are rightfully theirs. As Apple continues to dominate patent litigation headlines, it is aggressively working to improve its patent portfolio.

In 2010, Apple lagged behind its competition with awarded patents. It ranked 46 behind some of its biggest competitors including IBM, Microsoft, and Samsung.[2] According to IPAnalytx, a propriety patent database created by IP Software, Inc. (a sister company to Pellegrino & Associates), as of December 2012, Apple ranked 16 with more than 1,400 patent grants in 2012. For patent applications, Apple ranked 22 with more than 900 applications. While these are great improvements for building its patent portfolio, Apple hasn?t stopped there. Apple is also aggressively buying patents from other companies. In 2012, Apple purchased more than 1,000 patents. A significant number of those purchases were for telecommunications technologies that will likely fill gaps in Apple?s portfolio for technologies related to smartphones.

A Stanford University analysis reveals that the smartphone industry alone spent $20 billion in patent litigation and patent purchases in the last two years.[3] In fact, these companies now spend more money on litigation and patents than they do on research and development. Therefore, Apple?s strong interest in building its patent portfolio is a smart move. In 2012, Apple won a $1 billion patent infringement case against Samsung. This case alone provides proof of patent power.
